By purchasing a ticket and registering for Harry's Longest Mile, participants agree to these legally binding terms and conditions. Participation in Harry's Longest Mile is a recreational service that involves significant physical risk, including the risk of serious injury or death. You must read this entire document carefully before registering.
If you sign this form, you will be agreeing that your rights to sue the supplier under the Australian Consumer Law and Fair Trading Act 2012 are excluded, restricted or modified in the way set out in this form, if you are killed or injured because the services provided were not in accordance with the statutory guarantees outlined below.
Under the Australian Consumer Law (Victoria), several statutory guarantees apply to the supply of certain goods and services. These guarantees mean that the supplier named on this form is required to ensure that the recreational services it supplies to you—
Under section 22 of the Australian Consumer Law and Fair Trading Act 2012, the exclusion of these statutory guarantees is brought to your attention by this form.
NOTE: The change to your rights, as set out in this form, does not apply if your death or injury is due to gross negligence on the supplier's part. Gross negligence, in relation to an act or omission, means doing the act or omitting to do an act with reckless disregard, with or without consciousness, for the consequences of the act or omission. See regulation 5 of the Australian Consumer Law and Fair Trading Regulations 2012 and section 22(3)(b) of the Australian Consumer Law and Fair Trading Act 2012.
Participants must be 16 years of age or older on the day of the event. No person under 16 may register or participate. Participants aged 16 or 17 on the day of the event must have a parent or legal guardian acknowledge these terms in addition to the participant's own acceptance.
Registration is final upon payment. Registrations are non-refundable but may be transferred to another eligible participant up until 14 days before the event, subject to a $75 transfer fee and written approval. The transferee must also be 16 years of age or older on the day of the event and must accept these terms in their own name.
Where a registration is purchased by one person on behalf of another, clause 12 applies.
Harry's Longest Mile is a last-one-standing event. Participants complete a one-mile loop within a set cutoff time. The cutoff reduces each round. A participant who does not complete the loop within the cutoff, or who does not start the next round, is eliminated. The event continues until one participant remains in each prize category.
The format is designed to push participants to the limit of their capacity. The decision to start each round is entirely voluntary. A participant may withdraw at any time, for any reason or no reason, and is expected to withdraw immediately if they experience chest pain, breathlessness at rest, dizziness, confusion, disturbed vision, nausea, cramping, or any other sign of distress. No participant is ever required to start another round.
The participant acknowledges that participation carries risks that cannot be eliminated by the exercise of reasonable care by Hardcore Harry's AU Pty Ltd (ABN 45 672 771 863). These risks include, but are not limited to:
Participants acknowledge that these risks are obvious and inherent to a repeated maximal-effort endurance event, and that they voluntarily assume all such risks within the meaning of sections 53, 54 and 55 of the Wrongs Act 1958 (Vic).
The participant certifies that they are in sound health and are medically fit to participate in a repeated maximal-effort endurance event, and that they have obtained clearance from a medical practitioner if they are in any doubt.
The participant certifies that they have answered all health and medical questions asked during registration truthfully and completely, including any question about cardiac conditions.
Hardcore Harry's AU Pty Ltd (ABN 45 672 771 863) does not assess, and is not in a position to assess, any participant's fitness to take part. Responsibility for that assessment rests entirely with the participant.
Participants agree to abide by all event rules, to comply with the instructions of event staff, race officials and the designated safety officer, and to respect other participants. Hardcore Harry's AU Pty Ltd (ABN 45 672 771 863) reserves the right to disqualify any participant for unsafe or unsportsmanlike conduct without refund. Participants agree to cease participation immediately if directed to do so by event staff for reasons of safety.
To the extent permitted by law, and subject to the warning above, the participant waives, releases and forever discharges Hardcore Harry's AU Pty Ltd (ABN 45 672 771 863), its officers, employees, contractors, volunteers, sponsors and associated parties (the "Released Parties") from any and all claims, demands or causes of action for death or personal injury (including mental injury, and the aggravation, acceleration or recurrence of any injury or disease) arising out of or in connection with the participant's participation in the event.
This release does not apply where the death or personal injury is caused by an act or omission done or omitted to be done with reckless disregard, with or without consciousness, for the consequences of the act or omission, within the meaning of section 22(3)(b) of the Australian Consumer Law and Fair Trading Act 2012 (Vic).
To the extent permitted by law, the participant indemnifies the Released Parties against any claim brought by a third party for death or personal injury resulting from the participant's own acts or omissions during the event.
Hardcore Harry's AU Pty Ltd (ABN 45 672 771 863) holds public liability insurance. Participants should understand that public liability insurance does not cover a participant's own injury.
Participants are strongly encouraged to hold their own personal accident, health or income-protection insurance.
Hardcore Harry's AU Pty Ltd (ABN 45 672 771 863) reserves the right to modify the schedule, course or format, or to cancel the event, in response to adverse weather, venue issues, safety concerns, insufficient registrations or any event beyond its reasonable control. No refunds are payable in these circumstances except as required by law.
Registrations are non-refundable.
A registration may be transferred to another eligible participant up until 14 days before the event, subject to a $75 transfer fee and written approval. The transferee must be 16 or older on the day of the event and must accept these terms in their own name. Transfers requested within 14 days of the event will not be accepted.
Where a participant cannot take part and neither a refund nor a transfer is available to them, Hardcore Harry's AU Pty Ltd (ABN 45 672 771 863) may, at its absolute discretion, offer a credit of up to 50% of the entry fee towards a future Harry's event. This is a discretion and not an entitlement. No participant has a right to a credit, and a credit offered in one case creates no obligation to offer one in any other case.
Nothing in this clause excludes, restricts or modifies any right or remedy a participant has under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified.
Where a participant elects to pay by instalments, the entry is held from the date of the first successful payment, but is not fully paid until the final instalment has cleared.
If an instalment fails, the entry is suspended. The participant has 14 days from the date of the failed payment to bring the plan up to date. If the plan is not brought up to date within that period, the entry is forfeited and amounts already paid are not refunded, subject only to the discretion described in clause 10.
Payment plans close four months before the event. No new payment plan may be started, and no plan may remain outstanding, after 24 March 2027.
Where an entry paid by instalments is transferred, the payment plan remains the responsibility of the original purchaser unless Hardcore Harry's AU Pty Ltd (ABN 45 672 771 863) agrees otherwise in writing.
A person may purchase entries for other athletes in a single transaction. The purchaser is responsible for payment. Each athlete is individually bound by these terms.
An adult cannot accept these terms on behalf of another adult. Each athlete whose entry was purchased by someone else must complete their own registration and accept these terms in their own name, using the link sent to the email address supplied by the purchaser. That registration must be completed within 28 days of purchase. If it is not completed within that period, the entry is forfeited and the amount paid is not refunded, subject only to the discretion described in clause 10.
If an athlete whose entry was purchased by someone else is found, on completing their registration, to be under 16 on the day of the event or to have a cardiac condition that prevents participation, that athlete may not take part. In that case the entry may be transferred under clause 10, or the discretion described in clause 10 may be applied. Hardcore Harry's AU Pty Ltd (ABN 45 672 771 863) accepts no responsibility for a purchaser's decision to buy an entry for a person who is not eligible.
Race tees purchased as part of a group order belong to the purchaser's order and are supplied to the purchaser. Distribution of those tees is a matter for the purchaser, not for Hardcore Harry's AU Pty Ltd (ABN 45 672 771 863).
Camping is offered on the Friday and Saturday nights of the event weekend and is sold per vehicle. Camping is a separate service from participation in the event, and these terms apply to it in addition to any rules or directions of the venue.
Campers acknowledge the following additional risks, which are inherent to camping on an operating racecourse and cannot be eliminated by the exercise of reasonable care by Hardcore Harry's AU Pty Ltd (ABN 45 672 771 863):
Campers agree to: observe quiet hours between 9:00pm and 6:00am; keep vehicle movement within the camping area to a minimum and drive at walking pace; not light open fires; use cooking equipment and generators only in accordance with the manufacturer's instructions and never inside a tent or vehicle; supervise at all times any person under 18 in their care; and comply with all directions of event staff and venue staff.
Any alcohol service on site is governed by the venue's liquor licence and the directions of venue staff. Campers are responsible for their own conduct, and Harry's may remove any person from the camping area for conduct that affects the safety or amenity of others.
Camping is at the camper's own risk. Clause 18 applies to personal belongings left in the camping area, including belongings left in or on a vehicle.
By participating, the participant consents to the use of their image, voice, name and likeness in promotional materials produced by or for Hardcore Harry's AU Pty Ltd (ABN 45 672 771 863), including photographs, video, livestream footage, commentary, results graphics and social media content, in perpetuity and without further compensation. A participant who does not consent to this use must notify Hardcore Harry's AU Pty Ltd (ABN 45 672 771 863) in writing prior to the event.
Where a participant sends content to Hardcore Harry's AU Pty Ltd (ABN 45 672 771 863), submits it through any Harry's channel, or publishes it publicly and tags a Harry's account, the participant grants Hardcore Harry's AU Pty Ltd (ABN 45 672 771 863) a perpetual, irrevocable, worldwide, royalty-free, non-exclusive licence to use, reproduce, edit, adapt and publish that content in any medium, including in paid advertising, for the promotion of Harry's events and products.
The participant warrants that they own or otherwise control all rights in the content they submit, that they have the consent of any identifiable person appearing in it, and that its use will not infringe the rights of any third party.
This clause does not transfer ownership of the content. The participant retains ownership and may continue to use it however they wish.
Participants agree to follow the instructions of event staff and the designated safety officer in any emergency, to report any injury or medical concern to event staff as soon as practicable, and to consent to the provision of emergency first aid or medical assistance where they are unable to communicate their wishes.
Hardcore Harry's AU Pty Ltd (ABN 45 672 771 863) is not responsible for the loss, theft or damage of personal belongings brought to the event or to the camping area. All belongings are brought at the owner's own risk.
Personal information collected during registration is used for event administration, participant safety, results, and event communications. It is handled in accordance with the privacy policy published on the Hardcore Harry's website.
Marketing communications are sent only to participants who have separately opted in to receive them. Consent to marketing is not a condition of entry and may be withdrawn at any time.
These terms are governed by the laws of Victoria, Australia. Any dispute arising under them is to be determined by the courts of Victoria.
By ticking the acceptance box during registration and typing their name as a signature, the participant confirms that they are 16 years of age or older on the day of the event, that they have read and understood these terms in full including the warning, the inherent risks, the release and the indemnity, and that they accept and agree to be bound by them.
