By purchasing a ticket and registering for The Longest Mile, participants agree to these legally binding terms and conditions. Participation in The Longest Mile is a recreational service that involves significant physical risk, including the risk of serious injury or death. You must read this entire document carefully before registering.
Under the Australian Consumer Law (Victoria), several statutory guarantees apply to the supply of certain goods and services. These guarantees mean that the supplier named on this form is required to ensure that the recreational services it supplies to you:
Under section 22 of the Australian Consumer Law and Fair Trading Act 2012, the exclusion of these statutory guarantees is brought to your attention by this form.
Note: The change to your rights, as set out in this form, does not apply if your death or injury is due to gross negligence on the supplier's part. Gross negligence, in relation to an act or omission, means doing the act or omitting to do an act with reckless disregard, with or without consciousness, for the consequences of the act or omission. See regulation 5 of the Australian Consumer Law and Fair Trading Regulations 2012 and section 22(3)(b) of the Australian Consumer Law and Fair Trading Act 2012.
Participants must be 18 years of age or older on the day of the event. No person under 18 may register or participate, and no parent or guardian may register a minor on their behalf. Registration is final upon payment. Registrations are non-refundable but may be transferred to another eligible participant up until 14 days before the event, subject to a $75 transfer fee and written approval from Hardcore Harry's AU Pty Ltd.
The Longest Mile is a last-one-standing elimination event. Participants complete a one-mile loop within a starting cutoff of 20 minutes, with the cutoff reducing by 20 seconds each round. A participant who fails to complete a loop within the applicable cutoff is eliminated from the event. The format continues until one participant remains, or until all remaining participants are eliminated.
Participants acknowledge that the format is specifically designed to push them toward their individual physical limit over repeated rounds of progressively more demanding effort. The decision to start each new round is made voluntarily by the participant. Participants may withdraw from the event at any time, for any reason, and are expected to do so if they experience any symptoms of physical distress.
Participants acknowledge that The Longest Mile involves inherent risks that cannot be eliminated by the exercise of reasonable care by Hardcore Harry's AU Pty Ltd. Participants expressly assume all such risks as a condition of participation. These risks include, but are not limited to:
Participants acknowledge that these risks are obvious and inherent to a repeated maximal-effort endurance event of this nature, and that they voluntarily assume all such risks within the meaning of sections 53, 54 and 55 of the Wrongs Act 1958 (Vic).
By registering, the participant certifies that they are in sound physical and mental health, are physically prepared for a repeated maximal-effort endurance event, have no known medical condition that could be aggravated by participating, and have obtained medical clearance from a qualified medical practitioner where they are in any doubt about their fitness to participate. The participant further certifies that they have truthfully answered any health-related questions asked during registration.
Hardcore Harry's AU Pty Ltd does not, and is not qualified to, assess any participant's physical fitness or medical suitability for the event. All responsibility for assessing fitness to participate remains with the participant.
Participants agree to abide by all event rules, to comply with the instructions of event staff, race officials and the designated safety officer, and to respect other participants. Hardcore Harry's AU Pty Ltd reserves the right to disqualify any participant for unsafe or unsportsmanlike conduct without refund. Participants agree to cease participation immediately if directed to do so by event staff for reasons of safety.
To the extent permitted by law, and subject to the warning above, the participant waives, releases and forever discharges Hardcore Harry's AU Pty Ltd, its officers, employees, contractors, volunteers, sponsors and associated parties (the "Released Parties") from any and all claims, demands or causes of action for death or personal injury (including mental injury, and the aggravation, acceleration or recurrence of any injury or disease) arising out of or in connection with the participant's participation in the event.
This release does not apply where the death or personal injury is caused by an act or omission done or omitted to be done with reckless disregard, with or without consciousness, for the consequences of the act or omission, within the meaning of section 22(3)(b) of the Australian Consumer Law and Fair Trading Act 2012 (Vic).
To the extent permitted by law, the participant agrees to indemnify and hold harmless the Released Parties from any claims, damages or liabilities brought by any third party and resulting from the participant's acts or omissions during the event.
Hardcore Harry's AU Pty Ltd holds public liability insurance for the event. This insurance does not cover personal injury or illness suffered by participants themselves. Participants are strongly encouraged to hold their own personal health, accident and income-protection insurance adequate to cover potential injuries or other unforeseen incidents arising from participation in an endurance event of this nature.
Hardcore Harry's AU Pty Ltd reserves the right to modify the schedule, course or format, or to cancel, suspend or postpone the event, due to circumstances including but not limited to adverse weather, venue unavailability, safety concerns, insufficient registrations, or force majeure events. No refunds are provided for such changes or cancellations except as required by law.
Registration fees are non-refundable. A participant may transfer their registration to another eligible person (aged 18 or over) up until 14 days before the event (by 25 July 2026), subject to a transfer fee of $75 and written approval from Hardcore Harry's AU Pty Ltd. Transfers requested within 14 days of the event will not be accepted. Hardcore Harry's AU Pty Ltd may grant refunds only at its sole discretion.
By participating, the participant consents to the use of their image, voice, name and likeness in promotional materials produced by or for Hardcore Harry's AU Pty Ltd, including photographs, video, livestream footage, commentary, results graphics and social media content, in perpetuity and without further compensation. A participant who does not consent to this use must notify Hardcore Harry's AU Pty Ltd in writing prior to the event.
Participants agree to follow all emergency procedures and instructions provided by event staff and the designated safety officer. Participants agree to promptly report any injury, illness or medical concern affecting themselves or another participant to event staff. Participants consent to the provision of emergency first aid or medical assistance by event staff or emergency services where deemed necessary.
Hardcore Harry's AU Pty Ltd is not responsible for the loss, theft or damage of personal belongings during the event. Participants bring personal items to the venue at their own risk.
Hardcore Harry's AU Pty Ltd collects personal information from participants for event administration, safety, results and communication purposes, and uses this information in accordance with its privacy policy, available on the event website.
These terms and conditions are governed by the laws of Victoria, Australia. Any disputes arising from these terms or from participation in the event will be resolved in the courts of Victoria.
By ticking the acceptance box at registration, the participant confirms that they are 18 years of age or older, that they have read and understood these terms in full (including the warning above, the acknowledgment of inherent risks, the liability waiver and release, and the indemnity), and that they accept and agree to be bound by them.
