Welcome to Harry's: Challenges, a mobile application ("App") operated by Hardcore Harry's AU Pty Ltd ("we", "us", or "our"). By registering for an account and participating in fitness challenges available on our App, you agree to be bound by these Terms and Conditions (the "Terms"). Please read them carefully

1. Definitions

  • App: Refers to the Harry's: Challenges mobile application.
  • Terms: Refers to these Terms and Conditions.
  • User/You: Refers to anyone who registers for an account and uses the App.

2. Acceptance of Terms

By using Harry's: Challenges, you confirm that you accept these Terms and that you agree to comply with them. If you do not agree to these Terms, you must not use our App.

3. Eligibility

You must be at least 18 years old to use Harry's: Challenges. By agreeing to these Terms, you represent and warrant that you are of legal age to form a binding contract.

4. Account Registration

To access certain features of the App, you must register for an account. When registering, you agree to provide accurate, current, and complete information about yourself. You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. We assume no liability for any loss or damage arising from your failure to comply with the above requirements.

5. Subscriptions and Payments

  • Fees: You agree to pay the subscription fees for the services that you purchase on our App, and you authorise us to charge your chosen payment provider for any such amounts.
  • Renewal: Subscriptions are billed in advance on a recurring and periodic basis (monthly or annually), known as a "Billing Cycle." Your subscription will automatically renew at the end of each Billing Cycle unless you cancel auto-renewal through your account settings.
  • Refund Policy: Refunds for subscription cancellations will be handled according to our Refund Policy, which can be found at the bottom of this document.

6. Fitness Challenges

  • Participation: You are responsible for ensuring that you are physically and medically fit to participate in any challenges posted on our App. We are not liable for any health problems that may result from your participation in these challenges.
  • Rules: Each challenge will have specific rules and requirements, which will be available on the App. It is your responsibility to comply with these rules. If you do not comply with these rules, it may result in disqualification from the challenge/s.
  • Verification: The organisers reserve the right to verify the authenticity of the submissions. All decisions made by the organisers regarding the validity of submissions and the winner will be final.
  • Public Sharing:By submitting a video, participants agree to have their video shared publicly for the purpose of the challenge.

7. Prizes and Taxation

  • Prizes: Eligibility for prizes is contingent upon fulfilling all requirements set forth in the specific challenge rules. We reserve our right to disallow/disqualify any participant from a challenge if they do not meet the criteria set out in the challenge rules.
  • Taxes: You are solely responsible for any taxes incurred as a result of receiving a prize.

8. Intellectual Property Rights

We own all rights in the App and its entire contents, features, and functionality. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our App, except as permitted under these Terms.

9. User Content

You grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any content that you post on or through the App.

10. Privacy and Data Protection

  • Data Collection: We collect personal data necessary to provide our services. This includes but is not limited to name, age, and contact information. We commit to protecting your personal data in accordance with applicable privacy laws.
  • Data Usage: We use your data to manage your account, provide services, and improve and personalise your experience on the App. We will not share your data with third parties without your consent, except as necessary to provide our services or as required by law.

11. Consumer Rights

As a consumer, you have certain rights under the Australian Consumer Law, including statutory guarantees that our services will be provided with due care and skill, be fit for purpose, and be supplied within a reasonable time. You are entitled to a range of remedies if our services fail to meet these guarantees.

12. Dispute Resolution

  • Informal Dispute Resolution: We aim to resolve disputes informally. Please contact us if you have any concerns or disputes.
  • Formal Dispute Resolution: If we cannot resolve a dispute informally, we will agree to resolve it through binding arbitration or small claims court, depending on the nature of the dispute.

13. Changes and Updates to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. We will notify you of changes through the App or via email. Continued use of the App after any changes signifies acceptance of those changes.

14. Termination and Cancellation

  • User Initiated: You may cancel your subscription and terminate your account at any time via the account settings or by contacting us directly.
  • Company Initiated: We reserve the right to suspend or terminate your account if you breach these Terms or engage in illegal or fraudulent activities. Consequences of termination include the handling of user data according to our Privacy Policy and any ongoing obligations of the user.

15. Accessibility

We strive to make Harry's: Challenges accessible and user-friendly for all users, including those with disabilities. Our accessibility efforts are ongoing, and we continually improve the user experience in line with applicable standards.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia. Any disputes concerning these Terms will be subject to the exclusive jurisdiction of the courts of Australia.

17. User Responsibilities

You agree not to use the App in any way that:

  • Is unlawful, illegal, or unauthorised.
  • Is defamatory, harmful, abusive, or invasive of another’s privacy.
  • Infringes any intellectual property rights or other rights of any third party.
  • Transmits or procures the sending of any unsolicited or unauthorised advertising or promotional material.

18. Limitation of Liability

To the maximum extent permitted by law, Hardcore Harry's AU Pty Ltd will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the App; (b) any unauthorised access to or use of our servers and/or any personal information stored therein.

19. Indemnification

You agree to indemnify and hold harmless Hardcore Harry's AU Pty Ltd and its affiliates, officers, agents, employees, and partners from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the App, or your violation of these Terms.

20. Force Majeure

Hardcore Harry's AU Pty Ltd shall not be held liable for any failure or delay in performance due to any cause beyond its reasonable control, including, but not limited to, acts of war, acts of God, earthquake, flood, embargo, riot, sabotage, labor shortage or dispute, governmental act, or failure of the Internet.

21. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remainder of these Terms will continue to be valid and enforceable.

22. Account and Data Deletion

You can ask us to delete your Harry's: Challenges account, published by Hardcore Harry's AU Pty Ltd, at any time and for any reason. To request deletion, email info@hardcoreharrys.com.au with the subject line "Delete my account", and include your full name and the email address or username on your account. Sending the request from the email address linked to your account is the fastest way for us to verify it. We acknowledge requests within 5 business days, may ask a question or two to confirm you are the account holder, and complete the deletion within 30 days of verifying the request. Deletion is permanent: your challenge history, entries, and progress cannot be restored afterwards.

What we delete: your account and login credentials, your profile details (name, email, phone number, age, height, weight), your fitness activity, challenge entries and progress, your uploaded videos and photos, and your device identifiers, push notification tokens, and marketing preferences.

What we keep, and for how long:

  • Transaction and payment records: kept for 7 years, as Australian tax and financial record-keeping law requires. Held for compliance only.
  • Content already published as part of a challenge: entries, leaderboard placings, and winner announcements already shared publicly may remain published. On request we will remove or de-identify your name wherever it is reasonably possible to do so.
  • Records we are legally required to hold: information needed to meet a legal obligation, resolve a dispute, or investigate a breach of these Terms, kept only as long as that purpose requires.
  • Anonymised and aggregated data: usage statistics that can no longer identify you, which may be kept indefinitely.
  • Encrypted backups: deleted data may persist in secure backups for up to 90 days before it is overwritten.

Deleting your account does not cancel a subscription bought through the Apple App Store or Google Play. Cancel that subscription in your Apple or Google account settings first, otherwise the store may keep billing you. If you would rather access or correct your personal information than delete it, email the same address and tell us what you need.

Refund Policy

1. General Policy

All purchases made through the Harry's: Challenges mobile application ("App") are final and non-refundable, except as required by applicable law or as explicitly stated in this policy.

2. Subscriptions

Subscriptions to Harry's: Challenges are billed in advance on a recurring and periodic basis (monthly or annually), known as a "Billing Cycle." Your subscription will automatically renew at the end of each Billing Cycle unless you cancel auto-renewal through your account settings or by contacting us directly.

3. Cancellations and Refunds

  • Apple App Store: If you purchased a subscription through the Apple App Store, you must request a refund directly from Apple. Apple’s refund policy applies to all purchases made through their platform. For more information on how to request a refund from Apple, please visit Apple’s support page.
  • Google Play Store: If you purchased a subscription through the Google Play Store, you must request a refund directly from Google. Google’s refund policy applies to all purchases made through their platform. For more information on how to request a refund from Google, please visit Google Play’s support page.

4. Eligibility for Refunds

  • Technical Issues: If you experience a technical issue with our App that prevents you from using the subscription services, you may be eligible for a refund. Please contact our customer support team within 30 days of the issue occurring.
  • Unauthorised Purchases: If you believe a purchase was made fraudulently or without your authorisation, please contact our customer support team immediately. Unauthorised purchases may be eligible for a refund upon investigation.

5. How to Request a Refund

To request a refund for purchases made directly through our website or in cases of technical issues and unauthorised purchases, please contact our customer support team at info@hardcoreharrys.com.au. Please include the following information in your request:

  • Your full name
  • Email address associated with your account
  • Description of the issue
  • Date of purchase
  • Order number or receipt (if applicable)

Our team will review your request and respond within 5-7 business days.

6. Discretionary Refunds

In certain exceptional cases, we may grant refunds at our sole discretion. These cases will be evaluated individually by our customer support team.

7. Legal Rights

This Refund Policy does not affect any statutory rights you may have under Australian Consumer Law or other applicable legislation.

13. Breach Notification

In the unlikely event of a data breach that may compromise your personal information, we will promptly inform you and the appropriate regulatory bodies, in accordance with our obligations under the Privacy Act 1988 (Cth) and other relevant legislation.

14. Changes to The Policy

We may update this Privacy Policy periodically. We will notify you of any changes by posting the new Policy on our App. Continued use of our services signifies acceptance of the updated Policy.

15. Children's Privacy

We do not knowingly collect personal data from individuals under 18. If we learn that we have collected such data, we will delete it promptly. If you believe we have collected data from a minor, please contact us.

16. Phishing or False Emails

If you receive an unsolicited email that appears to be from us requesting personal information (such as your credit card, login, or password), do not provide the information or click on the link. Such emails are likely to be sent by someone trying to unlawfully obtain your information. Please report any suspicious emails to us at:info@hardcoreharrys.com.au.

17. Our Rights

We reserve the right to:

  • Modify or discontinue our services at any time.

Challenge Rules

These Challenge Rules apply to every challenge, sweepstakes, or contest offered through the Harry's: Challenges app, operated by Hardcore Harry's AU Pty Ltd. They sit alongside our Terms & Conditions. Individual challenges may add their own requirements, which are shown on the challenge entry page in the app.

Any challenge, sweepstakes, or contest offered through our app is in no way sponsored, endorsed, administered by, or associated with Apple Inc. Apple is not involved in any way with the development, organisation, execution, or fulfillment of any prizes associated with these promotions. By participating in any challenge, sweepstakes, or contest, you agree that Apple Inc. is not responsible for any issues, claims, or disputes that may arise from your participation. All responsibility for the administration and operation of the promotion lies solely with Hardcore Harry's AU Pty Ltd, and any inquiries, concerns, or claims should be directed to us, not Apple Inc.

1. Eligibility

  • Participants must be legal residents of Australia and at least 18 years old to enter.
  • Employees, contractors, and immediate family members of Hardcore Harry's AU Pty Ltd, its affiliates, and any sponsors are not eligible to participate.
  • The challenge is void where prohibited by law.

2. Entry Period

  • The challenge begins on the start date shown in that challenge's details in the app and ends on the end date shown in the same section.
  • All entries must be received by the end date of the challenge, as specified within the challenge details in the app, to be eligible.

3. How to Enter

  • Participants enter by downloading the app, completing the challenge, abiding by the challenge rules, and submitting an entry with evidence of completion.
  • No purchase is necessary to enter or win free challenges. Some challenges are only open to paid subscribers.

4. Challenge Requirements

  • Participants must complete all of the tasks outlined in the challenge rules to be considered for a prize.
  • Entries must adhere to the guidelines specified in the challenge. Any entry that does not meet the requirements will be disqualified.

5. Winner Selection

  • Winners are selected by random draw, skill-based criteria, or completion of certain tasks. Which method applies is clearly outlined in the specific challenge details.
  • All decisions regarding winner selection are final and binding.

6. Prizes

  • The prize for each challenge is listed on the challenge entry page of the app.
  • Prizes are non-transferable and may not be exchanged for cash or substituted, except at Hardcore Harry's sole discretion.
  • Hardcore Harry's AU Pty Ltd reserves the right to substitute a prize of equal or greater value if the advertised prize becomes unavailable.

7. Notification of Winners

  • Winners are notified by email, in-app notification, or phone within 1 business day after the challenge ends.
  • Winners must respond and claim their prize within 7 days of the notification. Failure to do so may result in disqualification and the selection of an alternate winner.

8. Publicity

By participating, entrants consent to Hardcore Harry's AU Pty Ltd using their name, likeness, and entry for promotional and advertising purposes in any media, without further compensation or notice, except where prohibited by law.

9. Taxes

Any and all taxes related to a prize are the sole responsibility of the winner. Hardcore Harry's AU Pty Ltd is not responsible for any tax liabilities.

10. Disqualification

  • Hardcore Harry's reserves the right to disqualify any participant or entry that violates these rules, attempts to manipulate the challenge process, or engages in fraudulent activity.
  • Use of automated or scripted means of participation is strictly prohibited.

11. Limitation of Liability

  • By participating, entrants agree to release and hold harmless Hardcore Harry's AU Pty Ltd, its affiliates, employees, and agents from any liability or claims arising out of participation in the challenge or the acceptance, receipt, or use of any prize.
  • Hardcore Harry's is not responsible for lost, late, misdirected, or incomplete entries due to technical or other issues.

12. General Conditions

  • Hardcore Harry's AU Pty Ltd reserves the right to cancel, suspend, or modify a challenge at any time for any reason, including but not limited to technical failures, fraud, or other issues beyond its control.
  • In the event of cancellation, Hardcore Harry's reserves the right to select winners from eligible entries received before the cancellation.

13. Privacy

Personal information collected in connection with a challenge is used in accordance with our Privacy Policy. Participants may review the Privacy Policy for details on how their data is handled.

14. Evidence

To ensure the integrity and fairness of our fitness challenges, we require athletes to submit evidence for verification. The type of evidence needed varies depending on the challenge you are entering. Insufficient or unclear evidence can lead to challenge rejections. Please read the following guidelines carefully to ensure your submissions meet the necessary criteria and help us verify your achievements accurately.

If you are unsure, it is always best to go above and beyond. Remember, some serious cash is at stake.

15. Video Evidence

When submitting video evidence, please follow these guidelines:

  • Full body visible: ensure your entire body is visible in the frame throughout the video. This allows us to verify your form and technique.
  • Good lighting: the video should be well lit to clearly show your movements and surroundings. Avoid dark or dimly lit environments.
  • Appropriate angles: the camera angle must be suitable to capture the entire repetition. For exercises like squats, deadlifts, or any movement requiring specific form checks, ensure the camera is positioned to provide a clear view. For some exercises, multiple angles may be necessary to provide a comprehensive view.
  • Unedited video: the video must be continuous and unedited to ensure authenticity. Do not cut, splice, or alter the footage in any way. This helps maintain the integrity of the evidence.
  • Stable recording: use a stable surface or a tripod to hold your recording device and avoid shaky footage, which can make it difficult to assess your performance.
  • Audio consideration: while not mandatory, clear audio can sometimes help verify the context of the activity, especially in group challenges or timed events.
  • Video size: although not mandatory, it is a good idea to upload smaller video files so they upload reliably and can be reviewed quickly.

16. Photo Evidence

When submitting photo evidence, please follow these guidelines:

  • Full body visible: ensure your entire body is visible in the photo. This is crucial for verifying posture, form, and equipment use.
  • Good lighting: the photo should be well lit to clearly show your position, equipment, and any relevant surroundings. Avoid backlighting, which can obscure details.
  • Appropriate angles: the camera angle must clearly capture your activity. For static poses, ensure the angle shows the necessary details of your position and any equipment being used.
  • Clear background: choose a background that does not distract from the main subject of the photo. Avoid cluttered or overly busy backgrounds.

17. GPS Fitness Wearables

A GPS fitness wearable is a device worn on the wrist or body that accurately tracks distance, speed, location, and heart rate using built-in GPS and heart rate monitoring. Eligible devices include Garmin GPS watches, COROS watches, Apple Watches, Fitbit devices with built-in GPS and heart rate monitoring, and similar fitness-focused wearables.

What does not qualify:

  • Devices that track GPS but lack built-in heart rate monitoring, unless connected to a separate, clearly documented heart rate monitoring device such as a Polar H10.
  • Simple heart rate monitors without GPS capability.
  • Smartphone-only apps without wearable integration, for example holding your phone and recording on Strava only.
  • Basic pedometers or step counters without GPS and heart rate tracking.

18. Strava Activity Links

To streamline evidence submission, we are moving towards accepting Strava activity links exclusively, particularly for run, cycling, and swimming challenges. When you record an activity using a GPS fitness wearable such as a Garmin watch, ensure it syncs automatically to your Strava account. Your Strava activity link should allow us to access the data we need for verification:

  • Running: must include pace, distance, heart rate, cadence, and elapsed time.
  • Cycling: must include distance, heart rate, and elapsed time.
  • Swimming: must include distance, heart rate, and elapsed time.
  • Workout: must include heart rate and elapsed time, along with the additional video or photo evidence specified for that challenge.

19. Additional Tips

  • Test your setup: before starting your activity, test your camera setup to ensure it captures the required angles and lighting. This can prevent issues during the actual recording.
  • Check your equipment: ensure your recording device is stable and has enough battery life and storage space for the entire recording. This prevents mid-activity disruptions.
  • Review before submitting: always review your evidence before submitting to make sure it meets all the guidelines. Check for visibility, clarity, and completeness.
  • Back up your evidence: keep a backup of your evidence until your challenge has been verified. This ensures you can resubmit if any issues arise during the verification process.
  • Provide context: if necessary, include a brief description or context with your submission. This can help the verification team understand specific aspects of your evidence, especially for complex challenges.
